Acceptance of These Terms
This website is operated by ARC SAFE LAYER, LLC, a limited liability company registered in the Commonwealth of Massachusetts and trading as ARC Safe Layer IT (“we”, “us”, “our”).
By accessing or using this website you agree to these terms. If you do not agree with them, please do not use the site. They apply to every visitor — someone passing through, a prospective client, or an existing client reading a page.
What These Terms Cover
These terms govern your use of this website: what you read here and what you submit through it.
They do not govern the IT services we deliver to clients. Managed IT, cybersecurity, backup and recovery, Microsoft 365 and cloud work, physical security, web work and any project we carry out are governed by a separate written service agreement and the statements of work made under it. Nothing on this website changes those documents, and nothing on this website is a substitute for having one.
What This Website Is
This website provides information about the managed IT and cybersecurity services offered by ARC Safe Layer IT. It is marketing and informational material.
Nothing on it constitutes a binding offer of services, a service level commitment, or professional advice you should act on without a conversation about your specific circumstances. No service is offered until a written service agreement is signed by both sides.
Informational Content
Articles and guidance published in the Resources section are general in nature. Technology, threats and vendor products change, and content that was accurate when written may become outdated.
This content is not legal, regulatory, financial or compliance advice. Do not treat it as a substitute for advice specific to your business.
No Compliance Guarantee
We describe technical controls that commonly support regulatory and professional obligations. We do not guarantee that any service, control or recommendation will achieve or maintain compliance with any law, regulation, framework or standard.
Responsibility for determining and meeting your compliance obligations remains with your business and its advisers.
Acceptable Use
You agree to use this website for lawful purposes only. In particular, you agree not to attempt unauthorised access to the site, its host, or any connected system; not to interfere with its operation, security or availability; not to submit false or misleading information through the contact form; not to impersonate anyone or misrepresent your affiliation; and not to use the site to send unsolicited commercial messages or to collect information about others without authorisation.
You may not copy, republish or redistribute substantial parts of this website, or scrape it at a rate that burdens it, without written permission.
Search engines and AI assistants are welcome here. Reading these pages to answer a question, and citing them with attribution, is exactly what they are published for, and this site is built to make that easy. What is not permitted is wholesale reproduction of the content as a substitute for it.
Intellectual Property
The content, design, layout, graphics and code of this website are owned by ARC SAFE LAYER, LLC or its licensors and are protected by applicable intellectual property law. You may view, print and download pages for your own reference.
Third-party product names, including Microsoft product names, are trademarks of their respective owners and are used here only to describe the services we support. ARC Safe Layer IT is an independent provider and is not affiliated with, endorsed by or sponsored by any vendor unless expressly stated.
Your Submissions
When you send us information through the contact form, you confirm that it is accurate, that you have the right to send it, and that sending it does not breach anyone else’s rights or any law.
You give us permission to use what you send for the purpose of replying to you, discussing work with you, and keeping a reasonable business record of the exchange. That permission ends when the submission is deleted under our Privacy Policy. We use it for nothing else.
Third-Party Links
This website may link to third-party sites — a vendor page, a published standard, a booking tool. We do not control those sites, are not responsible for their content, availability or privacy practices, and a link does not imply endorsement. You follow them at your own risk and under their terms.
Disclaimer of Warranties
This website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties of any kind regarding the site, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy.
We do not warrant that the site will be uninterrupted or error free, or that its content is complete or current. Any reliance you place on it is at your own risk.
Limitation of Liability
To the fullest extent permitted by law, ARC Safe Layer IT and the people who work for it will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of this website, including lost profits, lost data or business interruption, even if we were told such damages were possible.
Where liability cannot be excluded, our total liability arising out of or relating to this website will not exceed one hundred United States dollars (US$100).
These limits do not apply to our own fraud, gross negligence or wilful misconduct, to death or personal injury caused by our negligence, or to any liability that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions, and in those places our liability is limited to the maximum the law allows.
Indemnification
You agree to defend and indemnify ARC Safe Layer IT and the people who work for it against any claim, loss or cost, including reasonable legal fees, arising from your breach of these terms, your violation of any law or third-party right, or your misuse of this website.
Suspension and Termination
We may suspend or withdraw access to this website, in whole or in part, at any time and without notice, including where we reasonably believe these terms have been breached.
The sections that by their nature should outlast your visit — intellectual property, your submissions, disclaimers, limitation of liability, indemnification, dispute resolution and governing law — continue to apply after access ends.
Copyright Claims
We respect other people’s intellectual property. If you believe something on this site infringes your copyright, write to Info@arcsafelayer.com identifying the work, pointing us to the material on the site, and giving us a way to reach you, together with a statement that you believe in good faith the use is not authorised and that your notice is accurate. We investigate every notice we receive and remove infringing material.
Resolving Disputes
If something goes wrong, tell us first. Write to Info@arcsafelayer.com describing the problem, and we will try in good faith to sort it out with you within 30 days. Most disagreements end here.
If that does not resolve it, any dispute arising out of or relating to these terms or this website will be brought exclusively in the state and federal courts located in the Commonwealth of Massachusetts, and you agree to the personal jurisdiction of those courts. Either of us may instead bring an individual claim in small claims court where the claim qualifies.
Governing Law
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules.
If any provision of these terms is found unenforceable, it will be narrowed to the minimum extent necessary or removed, and everything else stays in force.
California Residents
Under California Civil Code section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Boulevard, Suite N-112, Sacramento, CA 95834, or by telephone at (800) 952-5210. California privacy rights are described in our Privacy Policy.
Changes to These Terms
We may revise these terms. The revised version applies from the date it is posted, and the “last updated” date and version shown above will reflect the change. Where a change is significant we will say so on the page for a reasonable period. Continuing to use the site after that means you accept the revised terms.
